1. Agreement to Terms
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Deepak's Art ("we," "us" or "our"), concerning your access to and use of the website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.
2. Custom Artwork Services
All custom portrait commissions are subject to the following terms:
- References: The quality of the final artwork depends heavily on the reference photo provided. We reserve the right to decline photos that are too blurry or lack necessary detail.
- Revisions: Minor revisions are included in the process before the final fixative spray is applied. Major changes deviating from the original photo reference may incur additional charges.
- Turnaround Time: Estimated completion times are approximate and may vary depending on our current workload. We will communicate any significant delays.
3. Intellectual Property Rights
Unless otherwise indicated, the Site and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us.
We retain the copyright to all artwork produced. We reserve the right to display commissioned artwork in our portfolio and social media unless otherwise agreed upon in writing before the commission begins.
4. User Representations
By using the Site, you represent and warrant that all registration information you submit will be true, accurate, current, and complete.
5. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the site.
6. Governing Law
These Terms shall be governed by and defined following the laws of India. Deepak's Art and yourself irrevocably consent that the courts of New Delhi, India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
